Welcome to Rugged By Nature® (“we,” “us,” and “our”). This website, ruggedbynature.com, is operated by Rugged By Nature, LLC. By accessing our site or purchasing from us, you agree to be bound by the following terms and conditions ("Terms of Service," "Terms of Use," "Terms"), including any additional policies linked or referenced.

By using this website, you engage in our “Service” and agree to the Terms. These apply to all site users: browsers, vendors, customers, merchants, and contributors.

You must be at least 18 years old or of legal age in your jurisdiction to use our services. We reserve the right to modify these terms at any time by posting updates. Continued use constitutes acceptance.

All content—text, logos, graphics, product designs, and photos—is owned by Rugged By Nature, LLC or used under license. This includes Rugged By Nature® and Fire Buckle®, which are registered trademarks.

Reproduction, distribution, or misuse of content or patented/trademarked items is prohibited. Violators may face legal action.

Section 3 – Product Use and Warranty

Products must be used responsibly and as intended. For example, the Fire Buckle® Belt’s primary function is to hold your pants—not to start fires.

Warranty: 1-year limited warranty covers defects in materials or workmanship. Excludes normal wear, misuse, improper care, or altered products. Ferro rods wear with use but can be replaced for a small fee. Email support@ruggedbynature.com.

Section 4 – Prohibited Uses

You may not use our website or content:

To infringe on intellectual property
To harass, abuse, discriminate, or deceive
To harm, spam, or spread malware
To violate security or regulatory standards

Violations will result in immediate service termination.

Section 6 – Colors and Accuracy

We strive for accurate descriptions and imagery but can’t guarantee your monitor’s color accuracy. Product descriptions and prices are subject to change.

By submitting reviews, ideas, or other content, you grant Rugged By Nature a royalty-free license to use, display, and publish it. You agree not to post anything unlawful, defamatory, or infringing.

We do not guarantee uninterrupted service. All products and services are provided "as is." Rugged By Nature®, its affiliates, and partners are not liable for any damages—direct or indirect.

Once shipped, product risk transfers to you. Porch theft and similar incidents are your responsibility.

Section 11 – Indemnification

You agree to indemnify and hold harmless Rugged By Nature® and affiliates from any claims arising from your violation of these Terms or misuse of the website.

Section 12 – Warranty Exclusions

We do not warranty damage due to misuse, improper care, or wear and tear. Some exclusions may not apply in all jurisdictions.

We do offer replacement Ferro rods for Fire Buckle® belts at a small cost.

Section 13 – Safety Notice

Outdoor activities can be dangerous. You assume all risks and responsibilities from use of our gear. Seek proper instruction before use.

Section 14 – Termination

These terms remain in effect unless terminated by either party. We reserve the right to terminate your access for violations.

Section 15 – Entire Agreement

These terms, combined with any policies linked on our site, constitute the entire agreement between you and Rugged By Nature.

All products purchased from this Website are transported and delivered to you by an independent carrier not affiliated with, or controlled by Rugged By Nature. Ownership to products purchased on this Website, as well as the risk of loss for such products, passes to you when Rugged By Nature delivers these items to the carrier. Any loss do to porch pirates is your responsibility.

SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Rugged By Nature® and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - LIMITED WARRANTY AND WARRANTY EXCLUSIONS We Warrant for one year that our products are free from defects in material and workmanship as well as there primary function. Example (Fire Buckle® Belt/Belts primary function is to hold up your pants; not to make fire). If Buyer discovers a defect, Buyer should return the Product to the place of purchase. If this is not possible then, return the product to us at the address provided. The product will be repaired or replaced at our discretion. That is the extent of our liability under this Warranty. Upon expiration of applicable Warranty period, all such liability shall terminate. We reserve the right to require proof of purchase for all Warranty Claims.

We Do Not Warranty Products against normal wear and tear (such as Fire Buckle® Belt Ferro Rods from use or detachment from abuse, abrasions, scratches). Unauthorized modifications or alterations, improper use, improper maintenance, accident, misuse, negligence, damage, or if the Product is miss used from the intention that it was designed for. We shall not be liable for direct, indirect, incidental, or other types of damages arising out of, or resulting from the use of product. This warranty is in lieu of all other warranties, express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. (Some States do not allow the exclusion or limitation of incidental or consequential damages or allow limitations on there duration of an implied warranty, so the above exclusions may not apply to you).

SECTION 17 - WARNING Some related activities shown or viewed on this Website or on one of our social media channels, are potentially hazardous and dangerous. Any person using equipment in any manner is personally responsible for learning the proper techniques involved, and assumes all risks and accepts full and complete responsibility for any and all damages and injury of any kind, including death, which may result from the use of any equipment purchased through this Website. There is no substitute for personal instruction by a qualified person well versed in all appropriate safety techniques.

You agree to defend, indemnify, and hold harmless Rugged By Nature, LLC. and its affiliates, successors and assigns, and its and their directors, officers, employees, agents, co-branders or other partners from and against any and all allegations, claims, demands, actions, causes of action, proceedings (whether threatened or pending), orders, damages, losses, liabilities, costs, expenses, including reasonable attorney's fees and other legal expenses, and judgments of any kind of nature, incurred by Rugged By Nature, LLC. arising out of or relating to your use of the Website, your violation of this Agreement, or your violation of any rights of another.

We may discontinue this Website at any time, for any reason, without notice. We can change the contents, operation, or any and all other features of this website at any time for any reason, without notice. We may discontinue or restrict your use of this Website at any time for any reason, without notice.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Rugged By Nature as a result of this Agreement or your use of this Website. Nothing contained in this Agreement is in derogation of Rugged By Nature's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of this Website or information provided to or gathered by Rugged By Nature with respect to such use.
